These Terms of Service apply when you visit or make a purchase from Bay & Celyn.

Bay & Celyn is a trading name of Carl Asparassa, a sole trader. Throughout these terms, “Bay & Celyn”, “we”, “us” and “our” refer to Carl Asparassa trading as Bay & Celyn.

Our online shop is hosted by Shopify, which provides the ecommerce platform that enables us to sell our products and services to you.

By placing an order through our website, you agree to these Terms of Service. Please read them carefully before ordering.

2. Using our website

You may use our website only for lawful purposes.

You must not:

  • Use the website in a way that could damage, disable or interfere with its operation.

  • Attempt to gain unauthorised access to the website, customer accounts or associated systems.

  • Introduce viruses, malicious code or other harmful material.

  • Use our products, designs, photographs or website content for unlawful or unauthorised commercial purposes.

  • Provide false, misleading or fraudulent information.

You must be at least 18 years old or have permission from a parent or legal guardian to place an order.

3. Products

We make reasonable efforts to describe and photograph our products accurately.

Colours may appear slightly different depending on your screen, lighting and the materials used. Small variations may also occur because many of our products are made, printed, finished or assembled by hand.

These natural and minor variations are not normally considered faults.

Product dimensions are approximate unless we state otherwise.

4. Personalised products

You are responsible for providing complete and accurate personalisation details when placing your order.

Please check all names, dates, addresses, spellings, punctuation, photographs and other information carefully before submitting your order.

We will normally reproduce personalisation exactly as it is supplied unless an obvious formatting adjustment is required for the design.

We are not responsible for mistakes contained in information submitted or approved by you. This does not apply where an error is caused by our failure to follow the information or proof you supplied.

We may contact you if information is missing, unclear or unsuitable. This may delay production and dispatch.

If we cannot obtain the information required to complete your order within a reasonable time, we may cancel the order and issue a refund.

5. Proofs and approval

Where a digital proof is included or purchased, it will be sent using the contact details supplied with the order.

You are responsible for checking the full proof, including all wording, spelling, dates, layout and personalisation.

Production may not begin until we receive your approval. Delays in approving a proof may affect the estimated dispatch or delivery date.

Once a proof has been approved and production has started, further changes may not be possible. If a change can still be made, an additional charge may apply.

Approval of a proof does not affect your legal rights if the finished product is faulty, not as described or does not match the approved proof.

6. Photographs and customer-supplied content

If you provide photographs, artwork, wording or other content, you confirm that:

  • You have permission to provide and use it.

  • Its use does not infringe another person’s copyright, privacy or other rights.

  • It is not unlawful, abusive, discriminatory or otherwise inappropriate.

We may refuse or cancel an order containing material that we reasonably believe is unlawful, harmful, offensive or infringes another person’s rights.

Customer-supplied photographs and personalisation details are used to create and fulfil the order in accordance with our Privacy Policy.

7. Orders

Submitting an order is an offer to purchase the products in your basket.

You will receive an automatic order confirmation after placing your order. This confirms that we have received the order but does not necessarily mean that we have accepted it.

A contract is formed when we accept your order and begin processing or producing it.

We may refuse or cancel an order if:

  • A product is unavailable.

  • The price or product information contains an obvious error.

  • Required personalisation information has not been provided.

  • We cannot fulfil the requested design or timescale.

  • We suspect fraud, misuse or unlawful activity.

  • Delivery is unavailable to the supplied address.

If we cancel an order after payment has been taken, we will refund the amount paid.

8. Prices and payment

Prices are shown in pounds sterling unless another currency is displayed.

The total price, including applicable delivery charges, will be shown before you complete checkout.

Payment must be made using one of the methods available at checkout. Payments are processed securely by Shopify and the relevant payment provider.

We may change our prices at any time, but this will not affect an order that we have already accepted.

If a price is clearly incorrect due to a genuine error, we may contact you to offer the option of paying the correct price or cancelling the order for a full refund.

Discounts and promotional codes are subject to their stated conditions. Unless expressly stated otherwise, only one discount may be used per order.

9. Production and dispatch

Production times vary depending on the product and level of personalisation. Current estimates are shown on the relevant product page.

Production times begin once we have received all required information and, where applicable, proof approval.

Any dispatch or delivery date is an estimate unless we have expressly agreed that a particular date is guaranteed.

During busy periods, including Christmas and peak wedding season, production may take longer. We will contact you if we become aware of a significant delay.

Choosing an upgraded delivery service does not reduce the stated production time unless you have also purchased an available rush-production service.

10. Delivery

Orders are delivered to the address provided at checkout. You are responsible for checking that the address is complete and correct.

We are not responsible for a delay or failed delivery caused by an incorrect or incomplete address supplied by you. Additional postage may be required if an order has to be sent again for this reason.

Delivery times are estimates provided by the relevant postal or courier service and are not guaranteed unless a guaranteed service has specifically been purchased.

If an order is delayed, lost or damaged in transit, please contact us so that we can investigate and provide an appropriate solution.

Nothing in this section limits your legal rights where goods are not delivered within an agreed or legally reasonable time.

11. International orders

International customers are responsible for ensuring that products can lawfully be imported into their country.

International deliveries may be subject to customs checks, import duties, taxes or handling charges. Unless collected at checkout or stated otherwise, these charges are the responsibility of the recipient.

Customs processing may delay delivery. We cannot control or guarantee customs-clearance times.

12. Changing or cancelling an order

Contact us as quickly as possible if you need to change or cancel an order.

We will try to help, but changes or cancellations may not be possible once a personalised or made-to-order item has entered production.

Personalised and custom-made products

The statutory right to cancel an online order because you have changed your mind does not normally apply to goods made to your specifications or clearly personalised for you.

We may still agree to cancel a personalised order before production begins, but this is at our discretion.

This exception does not affect your rights if the product is faulty, not as described or does not match the personalisation information or approved proof that you supplied.

Non-personalised products

For eligible non-personalised products purchased online, you normally have the right to cancel within 14 days of receiving the order without giving a reason.

You must tell us clearly that you wish to cancel. You then have a further 14 days to return the product.

Unless the item is faulty, incorrect or not as described, you are responsible for the cost of returning it.

Returned products may be inspected. We may make a lawful deduction if the product has been handled beyond what is reasonably necessary to inspect it and its value has been reduced.

Where the cancellation right applies, we will refund the product price and the cost of our least expensive standard delivery option. Any additional amount paid for an upgraded delivery service is not normally refundable.

The refund will be made within 14 days of receiving the returned goods or receiving evidence that they have been sent back, whichever occurs first.

13. Faulty, damaged or incorrect products

You have legal rights under the Consumer Rights Act 2015. Products must be as described, of satisfactory quality and fit for their intended purpose.

If your order arrives faulty, damaged, incorrect or not as described, please contact us as soon as reasonably possible at hello@bayandcelyn.co.uk.

Please include your order number, a description of the problem and photographs where helpful.

Depending on the circumstances and your legal rights, we may offer a repair, replacement, repeat production, price reduction or refund.

We will cover reasonable return costs where goods are faulty, incorrect or not as described.

Personalised products are still protected by these rights. The personalised nature of an item does not remove your rights where the product is faulty or we have made an error.

14. Digital products

Digital products are supplied electronically and no physical item will be posted unless the product description states otherwise.

Where you expressly agree to receive digital content immediately and acknowledge that this means losing your statutory cancellation right, the right to cancel will end when the download or supply begins.

You may use a purchased digital product only for the personal or commercial purposes expressly stated in its product description or licence.

Unless expressly permitted, you must not resell, redistribute, share, copy or make our digital products available to others.

Your statutory rights remain unaffected if digital content is faulty or not as described.

15. Intellectual property

All original designs, illustrations, photographs, product images, wording, graphics, branding and website content belonging to Bay & Celyn remain our intellectual property unless stated otherwise.

Purchasing a product does not transfer ownership of the design or grant permission to reproduce, copy, resell or commercially exploit it.

You may share photographs of products you have purchased for personal, non-commercial purposes, provided our work is not misrepresented.

16. Reviews and customer photographs

If you submit a review, photograph or other content for publication, you confirm that it reflects your genuine experience and does not infringe another person’s rights.

We will obtain appropriate permission before using customer photographs for promotional purposes where that permission is required.

17. Third-party services and links

Our website may contain links to services operated by third parties, including payment providers, social media platforms and delivery services.

We are not responsible for the content, availability, security or privacy practices of third-party websites. Their own terms and policies will apply when you use them.

18. Website availability

We aim to keep our website accurate, secure and available, but we cannot guarantee uninterrupted or error-free access.

We may update, suspend or withdraw parts of the website where reasonably necessary for maintenance, security, legal or operational reasons.

19. Our responsibility to you

We are responsible for losses that are a foreseeable result of our breach of these terms or failure to use reasonable care and skill.

We are not responsible for losses that were not foreseeable when the contract was formed or for business losses arising from a purchase made wholly or mainly for business purposes.

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for:

  • Death or personal injury caused by negligence.

  • Fraud or fraudulent misrepresentation.

  • Breach of your statutory consumer rights.

  • Any other liability that cannot legally be excluded or limited.

20. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, such as severe weather, postal disruption, transport interruption, fire, flood, power failure, supplier failure or government action.

If such an event significantly affects your order, we will contact you as soon as reasonably possible and take reasonable steps to reduce the delay.

Your statutory rights, including any right to cancel because of a substantial delay, remain unaffected.

21. Privacy

We process personal information in accordance with our Privacy Policy.

By using our website, you acknowledge that information may be processed by Shopify and other service providers required to operate our shop, process payments and fulfil orders.

22. Changes to these terms

We may update these Terms of Service to reflect changes to our products, services, business practices or legal obligations.

The terms applying to an order will normally be those displayed when the order was placed.

The latest version will be published on this website with an updated revision date.

23. Severability

If any part of these terms is found to be unlawful or unenforceable, the remaining sections will continue to apply.

24. No waiver

If we do not immediately enforce a right under these terms, this does not mean that we have given up that right.

25. Governing law

These terms are governed by the laws of England and Wales.

If you are a consumer living elsewhere in the United Kingdom, you may also benefit from mandatory protections under the law where you live and may bring proceedings in the courts available to you under applicable law.
